Collection

We are frequently hired to collect business or personal debts for businesses or individuals. Generally the liability and damages are clear. The difficulties with the cases are typically (1) finding the responsible party to serve with summons and complaint; and (2) collecting the judgment.

We can generally find and serve the responsible party. We have sources to find even those who would prefer not to be found. However, whether the responsible party can or will pay the damages is determined by factors outside our control. To avoid spending money on attorney fees, investigation expenses, and court costs which will never be recovered, we have a realistic discussion regarding the debtor’s available income and assets prior to starting with the case. If you are not going to recover the debt, you probably do not want to spend money securing a worthless judgment.

After the responsible party is served, the court cases typically are resolved by judgment without the need for a hearing based on an “Affidavit of Damages” which is signed by the Plaintiff. Once the judgment is entered, we garnish bank accounts and those who owe the responsible party money, including employers, and sell non-exempt assets of the responsible party until the judgment is paid.
